1.75em;"><span style="font-size: 15px;">首先，出借人通过P2P网贷平台进行投资理财，借款人通过平台进行融资，首先会通过P2P平台官方网站进行注册，与平台签订注册协议或服务合同，这是借贷双方与平台之间所产生的第一种法律关系。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">然后、在平台纯中介经营模式下，出借人自行选择理财产品或者投资项目后，借贷双方和平台共同签订融资服务协议、借款协议等合同。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">此类合同在司法实践中通常被认定为民间借贷合同，合同中应明确约定借贷双方的个人信息、借款明细，包括借款本金、利息、借款期限、还款方式、借款用途等内容，并且平台会在借贷合同中约定居间服务条款，以平台管理费等形式收取居间服务费。这是借贷双方与平台之间形成的第二种法律关系。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">还有一些平台在提供居间借贷服务之外，自行组织设立投资项目，或者将众多融资项目、借款标的拆分再打包成固定收益的理财产品，来满足出借人的投资需求，此时出借人与平台之间签订的是委托理财合同，是为双方形成的第三种法律关系。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">此外、还有一些P2P网贷平台提供债权转让形式的服务创新，即为保障出借人资金的流动性，允许出借人在资金出借后、到期前，或借款人不能按期偿还时，可以将全部或部分债权转让给平台，再由平台进行再次转让或代替出借人进行违约救济。这种情形下，出借人与平台之间形成第四种债权转让合同关系。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><strong><span style="font-size: 15px;">3.保存证据及时起诉</span></strong></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">基于上述几种合同法律关系，依据2016年8月17日银监会、工业和信息化部、公安部、国家互联网信息办公室联合制定的《网络借贷信息中介机构业务活动管理暂行办法》的相关规定，平台应承担客观、真实、全面、及时进行信息披露的责任，应当履行对出借人和借款人的资格条件、信息的真实性、融资项目的真实性及合法性进行必要审核。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">发</span><span style="line-height: 1.75em;font-size: 15px;">现欺诈行为或其他损害出借人利益的情形应及时公告并终止相关网络借贷活动，具有保障交易安全、账户安全，保护用户隐私权，进行风险提示及明确双方权利义务等责任。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">遇到平台跑路，一些不理智的投资者哄抢了平台营业场所的办公设备，这样做显然无济于事。一旦遇到平台跑路、经营不善、提款困难等情形，投资者应当理性分析，依据合同规定的权利义务，找准平台责任和借款者责任，按照合同相对性原则，起诉与自己签订合同的相对人——平台或者借款人。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">通过民事诉讼程序维权的投资者，需要保存好平台服务协议、交易记录、电子借款合同、转账凭证、平台网站截图、经营宣传资料等证据材料，以便诉讼过程中法院查明事实、分清责任。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">如2015年，投资者秦先生在某财富网络借贷平台上注册了会员并进行在线充值，向平台及平台法定代表人赵某转款19万余元用于投资理财，秦先生与平台之间形成借贷法律关系，之后平台将秦先生的资金出借给了其他会员。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">2016年初，所有借款会员偿还了最后一笔借款后，秦先生向平台申请提现，但平台却将秦先生账户内10万余元的资金冻结，导致秦先生不能提现。由于一家酒业公司为秦先生与平台之间的借款合同提供了担保，以其资产、房屋及全部货物为平台的融资提供连带担保责任，于是秦先生便将某财富网络借贷平台、平台法定代表人赵某及提供担保责任的酒业公司一同告上法庭，要求三者共同偿还借款本金及利息，最终获得法院支持。</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">最高人民法院《关于审理民间借贷案件适用法律若干问题的规定》中第22条规定：“网络贷款平台的提供者通过网页、广告或者其他媒介明示或者有其他证据证明其为借贷提供担保，出借人请求网络贷款平台的提供者承担担保责任的，人民法院应予支持。”</span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;"><br></span></p><p style="text-align: justify;line-height: 1.75em;"><span style="font-size: 15px;">也就是说，虽然《网络借贷信息中介机构业务活动管理暂行办法》要求网贷平台不得为借贷提供担保，</span><span style="color: rgb(255, 41, 65);font-size: 15px;">但如果网贷平台为了吸引出借人投资，通过网页、广告或其他形式明示宣传其为借贷提供担保的，由于借款人的原因不能偿还借款，出借人也可以请求网贷平台承担连带担保责任或补充担保责任。</span></p><p style="font-size: 16px; text-align: center; line-height:
